I am writing to you on behalf of Rabar's anti deportation campaign. Rabar is an Iraqi Kurd. Rabar has been living in the UK for the last two years. He is a 16 year old child (D.O.B 9/10/1993) and is in an age dispute with Wigan Council who claim that he is actually 20 (D.O.B 1/1/1990). He is currently detained in Colnbrook IRC. Rabar is most likely suffering from Post Traumatic Stress Disorder as a result of the trauma he has been through. The Home Office refuses his claim of asylum and he has since been evicted from his children's home in Oldham.
When Rabar arrived in the UK in 2008 he was 14, he was age assessed as being 18 by Wigan Social Services. He then spent a year living in a hostel with other unaccompanied male asylum seekers. Following his inability to fend for himself and a medical expert's age assessment, who assessed Rabar as between 13 and 15 years of age, he was subsequently placed in Alexandra Children's Home in 2009 and attended Breeze Hill School in Oldham where he thrived. When Rabar was placed in the children's home, Wigan Social Services failed to notify your department and the UK Borders Agency of his new address and that he had been placed as a minor. Therefore, UKBA and your department had Rabar as an Absconder for five months when in fact he was a Looked After Child.
Rabar was age assessed again in 2010 by Roisin McLoughlin, Social Worker at Wigan Social Services, who agreed with the initial age assessment and that said Rabar was 18 when he arrived in the UK and 20 now.
In Iraq, under Saddam Hussain, Rabar's father was employed by Saddam's Ba'ath Party as a Kurdish spy. After the fall of Saddam Hussain, Rabar's father went into hiding and Rabar, along with his mother and sister Pawar (who was born in 2000) also went into hiding but in a separate address. Rabar grew up unaware of his father's employment.
In 2008, whilst Rabar and his sister were out of the house visiting a paternal uncle (the only family member he knows of) he heard a bomb explosion and saw that his house was in flames, with his parents in it. He was then put into hiding by his uncle and a few weeks later placed in the wheel arch of a lorry and driven to the UK where he applied for asylum.
Rabar has a new solicitor who is in the process of appealing against the age determination. She has consulted a barrister who is of the opinion that he has a good case with which to seek a Judicial review. Unfortunately whilst he was on his way to a case conference with his barrister he was detained by the UK Border agency and taken to Colnbrook, where he has been served with a Notice of Removal for Tuesday 31st August. This will return him to Iraq where his life will be in serious danger.
This detention has prevented him from exercising the opportunity to contest his case. I feel that this is a denial of his basic right to justice.
His teachers, his friends, his care workers at the children's home and his football coaches are all firmly of the opinion that Rabar is 16 as he claims. This is based on years of experience. This experience has been ignored in all his hearings. Medical evidence of his age has also been ignored. I feel that this is a denial of his rights to natural justice.
He has many friends and has begun to make a place for himself in Oldham, where he has been living. He has settled into the life of the school and his local community. Given the opportunity he can become a valued member of British society, able to make a valuable contribution to the life of this country.
If he is returned to Iraq there is a serious danger he will be killed.
I am therefore appealing to you on humanitarian grounds to rescind the Notice of Removal and allow him the opportunity to submit a new claim for asylum and to contest the age determination.

This lovely lady on fb has a couple little problems atm so please express your solidarity and support her and her fam any way you can. I canae find the link atm and need go out soon but the short version is her loving hubby was fitted up by the violent police and is currently in jail. Fkn Outrage and even though i know it will work out best for these good people and worse for these outrageous hypocritical govts it still pisses me rite off. But then im coming back to life and as i already suspected compassion fatigue is a nasty rumour.
